Board Compliance Certificate Insurance Agencies Compliance CertificateThe Insurance Law No. 5684 was published in the Official Gazette on June 14, 2007, and entered into force.In the Insurance Law No. 5684, an insurance agency is defined as "a person who, without having a dependent status such as a commercial representative, commercial agent, sales clerk, or employee, engages in the profession of intermediating insurance contracts on behalf of and for the account of insurance companies or making them on behalf of insurance companies within a certain place or region on a permanent basis, conducting preparatory work before the conclusion of the contract, and assisting in the implementation of the contract and the payment of compensation." The Insurance Agencies Regulation determines the procedures and principles regarding the qualifications and activities of real and legal persons who will engage in insurance agency activities.In this context, it is mandatory for insurance agencies to comply with the conditions determined in terms of procedures and principles and to register with the board. Real and legal person firms established to engage in insurance agency activities must meet the qualifications specified in Article 4 of the Insurance Agencies Regulation.ARTICLE 4 - Qualifications required for real and legal person agencies(1) The following qualifications are required for real persons who will engage in agency activities:a) Being resident in Turkey,b) Having the capacity to exercise civil rights,c) Not having been convicted or penalized for the crimes specified in subparagraph 4 of paragraph (a) of the second paragraph of Article 3 of the Law,d) Not having declared bankruptcy and not having announced concordat,e) Having the qualifications of technical personnel,f) Meeting the minimum asset requirement,g) Being sufficient in terms of physical, technical, and administrative infrastructure and human resources.(2) The following qualifications are required for legal persons who will engage in agency activities:a) Having their headquarters in Turkey,b) Not having declared bankruptcy and not having announced concordat,c) Meeting the minimum capital requirement,d) Being sufficient in terms of physical, technical, and administrative infrastructure and human resources.(3) The following qualifications are required for the officials of legal persons who will engage in agency activities, real person partners, and the officials of legal person partners:a) Not having been convicted or penalized for the crimes specified in subparagraph 4 of paragraph (a) of the second paragraph of Article 3 of the Law,b) Not having declared bankruptcy and not having announced concordat.(4) The condition of not having declared bankruptcy and not having announced concordat is required for the legal person partners of legal persons who will engage in agency activities.(5) The officials of legal persons who will engage in agency activities, who are authorized to represent and bind the company in terms of insurance transactions, must meet the other qualifications specified in subparagraphs (e) and (f) of the first paragraph.(6) Real person agencies with the authority to make contracts or collect premiums and the managers of legal person agencies or those who perform this duty in practice, even if they do not hold this title, must meet the other qualifications specified in subparagraphs (d), (e), and (f) of the first paragraph, and must have graduated from at least four-year higher education institutions or at least two-year higher education schools related to actuarial science, marketing, risk management, and insurance, and must have gained two years of professional experience.Insurance Agencies established in compliance with the required qualifications and conditions must apply to our Chamber with the preliminary application number and the Minimum Physical Conditions Inspection Report request petition provided by the system, along with the required documents, by making a preliminary application on the website www.sigorta.gov.tr.
